The First National Bank of Pandora, Ohio is pleased to offer and provide free TeleBanc and Internet Banking access to customer accounts by acceptance of this agreement. The purpose of this agreement is to identify, describe and state the general terms and conditions that will apply to phone and internet-based banking services offered by The First National Bank of Pandora ("The Bank"). The Terms "you" and "your" will identify and refer to each person who applies for and is granted online banking access to any account or service offered by The Bank. The Term “online banking” refers to both TeleBanc and basic Internet Banking. Upon acceptance of this agreement, a valid and binding contract between you and the Bank exists.
You understand, instruct and agree that The Bank is entitled to act upon instructions received with respect to any online banking service under your user ID and secret password and without further inquiry into the identity of the person using the password. The Bank will establish online banking access for you using a default password. You shall immediately change your password and User ID upon your first login. You agree that you will not under any circumstances disclose your password to anyone, including anyone claiming to represent The First National Bank of Pandora. Our employees do not need your password for any reason.
You are liable for all transactions made or authorized with the use of your password. You understand and agree that in online banking access, The Bank may have no knowledge and can assume no responsibility to establish the identity of any person who uses your secret password; you agree that you will never give your password to anyone. If you do give someone your password you have failed to protect its secrecy. You do so at your own risk and liability. You are specifically informed that anyone with your password will have access to all of your accounts. You agree that if you believe the secrecy of your password has been compromised, you will immediately notify The Bank. The Bank will immediately change your password.
For joint accounts, each person must have a separate password. Each person on a joint account will be responsible for all transactions that are made on that account by all other joint holders of the account.
To the extent permitted by law, you agree to fully indemnify and release The Bank from any and all liability, and agree not to make any claim against The Bank or bring any action against The Bank, relating to its honoring and allowing any actions or transactions that were conducted under your user ID and secret password.
By directing The Bank to transfer funds or make a payment of any kind through the use of any online banking service initiated with your user ID and secret password, you authorize The First National Bank of Pandora, Ohio to withdraw or transfer the funds necessary to complete the designated transaction. Requests for new account services instruction to change existing account information or services and other communications received by The Bank through the internet access shall constitute legal endorsement, and shall have the same force and effect as a writing signed by you.
On-line Bill Payment (this is different than on-line
banking), service is free but the bank reserves the right
to charge for this service in the future . You would be notified if
a charge is ever assessed in writing and given the ability to cancel.
Because of the possibility of human and mechanical error as well as other factors, The First National Bank is not responsible for any error in or omissions from the information contained in or accessed through our website. All such information is provided "as is: to the user without express or implied warranties of any kind including the warranties of merchantability, non-infringement of intellectual property or fitness for any particular purpose. Furthermore, The First National Bank will not be liable for any delay, difficulty in use, inaccuracy of information, computer viruses, malicious code or other defect in the website, or for the incompatibility between this website and files and the user's browser or other site accessing program, nor will The First National Bank be liable for any other problems experienced by the user due to causes beyond The First National Bank's control. The First National Bank will not be liable for any delay that may cause lost profits or lost opportunity, or any indirect, special, consequential, incidental or punitive damages by the inability to access accounts on-line for any reason.
